SGM Terms and Conditions
By purchasing, enrolling in, or using any SGM product or service, including DVDs, training programs, online courses, streaming videos, instructor kits, templates, and e-books, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These documents together constitute the entire agreement between you and SGM Training Systems (“SGM”).
These Terms and Conditions apply to all users of SGM products and services, including business customers, individual purchasers, group leaders, and students enrolling in any online program.
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use SGM products or services.
- Access and Usage
Access to course content is for your internal business or personal use only and is non-transferable. Sharing login credentials, distributing training materials outside your organization, or reselling any part of the product is strictly prohibited.
- Content Protection and Intellectual Property
All SGM content, videos, documents, exams, templates, and other materials, is protected by copyright and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of any SGM content
- Resell, sublicense, or publicly share any materials
- Reverse engineer, extract, or manipulate any content or platform features
- Use materials in a way that violates any laws or third-party rights
All intellectual property rights remain exclusively with SGM. Any misuse may result in termination and legal action.
- Privacy Policy
By using SGM services, you acknowledge that personal data is collected, stored, and processed according to our Privacy Policy, which is incorporated by reference. You are responsible for ensuring any data you provide complies with privacy laws in your jurisdiction.
- Technical Requirements
Students and businesses are responsible for maintaining adequate internet access and compatible devices. SGM is not responsible for service disruptions caused by your technical limitations.
- Certification
Certificates of completion are issued only upon full course completion, including meeting all required steps and scoring 80% or higher on the final exam.
- Initial VOD and Academy Procedures
Upon purchasing the VOD or Academy program, immediate access to the training library will be granted. Employee access is time-limited and may expire if not used; renewals are available upon request. Program access, pricing, and plan options are subject to change. For the most current details, refer to your onboarding email or the sales page at the time of purchase.
Do not share your personal login information, as it contains billing and credit card details.
Pricing is subject to change with prior notice.
- Licensing and Regulatory Compliance
SGM’s training programs are for informational and educational use only. They do not guarantee compliance with specific state or regulatory requirements. It is your responsibility to confirm whether the content satisfies applicable local, state, or federal licensing standards. SGM does not provide licensure, certification, or job placement guarantees.
- Security Industry Standards & Employer Discretion
SGM’s materials are based on general industry standards and practices. However, individual employers or states may have specific content requirements. SGM is not responsible for any disciplinary actions, licensing denials, or employment outcomes.
- Content Disclaimer and Jurisdictional Compliance
SGM’s training and templates reflect the methodologies, experience, and views of SGM. They do not constitute legal, regulatory, or professional advice. Users are responsible for ensuring content aligns with their jurisdiction’s laws and their employer’s internal policies. If there is a conflict, users should consult appropriate professionals and not implement conflicting content. SGM is not liable for legal or operational consequences from the misuse of its materials.
- Refunds and Cancellations
All sales are final. No refunds will be given for VOD programs, online Academy courses and programs, DVDs, instructor kits, digital templates, or any other SGM product. Unauthorized chargebacks will be contested. Accounts may be suspended or referred for collection if disputes are filed after access is granted.
- Non-Guarantee of Results
SGM does not guarantee employment, results, or business success from the use of its programs. Results depend on individual application and external factors beyond our control.
- Content Usage Restrictions
All SGM materials are protected by copyright and may not be used, copied, or redistributed outside the terms specified here. Commercial resale, sublicensing, or public presentation is strictly prohibited.
- Add-On Services and Subscription Terms
Optional add-on services (e.g., additional employee seats) may be billed separately and may have billing cycles that differ from your main subscription. Add-on pricing is clearly disclosed at time of purchase and will continue until canceled.
All monthly subscriptions renew automatically every 30 days, and annual subscriptions renew every 365 days. By subscribing, you authorize SGM to charge your payment method on file for each billing cycle. If a payment fails, SGM may retry the same method or use an alternate method on file, if available.
- Cancellation
You may cancel your subscription anytime through your dashboard or by emailing support@sgmtraining.com. Email cancellations are effective only after you receive written confirmation from SGM. Failure to cancel before renewal constitutes acceptance of the next billing cycle. All cancellations take effect at the end of the current billing period. Access will remain active through the paid term, after which the account will be closed.
- Right to Modify Services
SGM reserves the right to update, suspend, or discontinue any product or service at its discretion. Significant changes will be communicated to current customers. SGM is not responsible for any inconvenience or business impact caused by these modifications.
- Use of Services and Compliance with Laws
You are solely responsible for ensuring that your use of SGM’s content complies with all laws applicable to your location and training goals, including data privacy laws, employment laws, and security training mandates. SGM disclaims liability for failure to meet external compliance obligations.
- Limitation of Liability
To the fullest extent allowed by law, SGM disclaims liability for any indirect, incidental, or consequential damages, including lost profits, data loss, business interruption, or reputational damage. SGM’s total liability under any claim shall not exceed the total amount paid by the customer to SGM in the 30 days preceding the claim.
- Force Majeure
SGM is not responsible for delays or failures to deliver services due to events outside of its control, including but not limited to natural disasters, internet outages, cyberattacks, pandemics, labor disputes, or government restrictions.
- Indemnification
You agree to indemnify, defend, and hold harmless SGM, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of any SGM product or service; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of a third party.
- Termination
SGM may terminate or suspend your account for lack of payment, inactivity, or any breach of these Terms. Termination does not waive outstanding balances owed to SGM.
- No Resale or Sub-licensing
SGM products and services may not be packaged, sublicensed, resold, or offered as part of any other product or service without written authorization. Unauthorized redistribution or integration into other training systems is strictly prohibited.
- Changes to Terms
SGM reserves the right to update these Terms at any time. Posting on our website will serve as notice. Continued use of SGM products after the effective date of changes constitutes your agreement to the revised Terms.
- Severability
If any provision in these Terms is found to be unenforceable, the remaining provisions will remain in effect and enforceable.
- Governing Law and Jurisdiction
These Terms and any related disputes shall be governed by the laws of the State of Delaware. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Delaware unless otherwise agreed in writing. You agree to waive any right to a jury trial or to participate in any class or collective action. If arbitration is not enforceable in a particular case, you agree that the exclusive jurisdiction and venue shall be the state or federal courts located in Delaware.
- Disclaimer of Warranties
All SGM products and services are provided “as is” and “as available,” without warranties of any kind, either express or implied. To the fullest extent permitted by law, SGM disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service. Your use of the products is at your sole risk.
